By accessing and using ProfileTrace ("the Service"), you accept and agree to be bound by these terms. These terms apply to all users of the service.

2. Description of Service

ProfileTrace provides digital profile search services. Results are derived from publicly available or third-party data using automated tools, including AI. We do not guarantee the accuracy, completeness, or current status of any data provided.

3. User Accounts

To access our services, you must:

• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized use.

4. Credits and Payment

Our service operates on a credit-based system. Credits are required to perform searches and must be purchased in advance. Credits are non-transferable and subject to our Refund Policy. All payments are processed via Stripe and will appear as "Syde6" on your billing statement.

5. Acceptable Use

You agree not to use our service for any illegal purpose, including:

• Illegal or fraudulent activities.
• Harassment, stalking, or defamation of individuals.
• Violating the privacy rights of others.
• Any use that violates the Fair Credit Reporting Act (FCRA). ProfileTrace is not a Consumer Reporting Agency.
• Automated scraping, data mining, or service circumvention.

6. Intellectual Property Rights

All rights, title, and interest in and to the Service (excluding user-provided data) are and will remain the exclusive property of ProfileTrace and its licensors.

7. Privacy and Data

Please review our Privacy Policy to understand how we collect, use, and protect your data. Depending on your location, you may have additional rights under laws like GDPR or CCPA.

8. Indemnification

You agree to indemnify, defend, and hold harmless ProfileTrace and its affiliates from any claims, damages, or liabilities arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

9. Termination

We may suspend or terminate your access at any time for any reason, including if you breach these Terms. You may cancel your account at any time by contacting us.

10. Limitation of Liability

ProfileTrace provides the Service "as is." We make no warranties and shall not be liable for indirect, incidental, or consequential damages arising from your use.

11. Arbitration and Dispute Resolution

Any dispute arising out of these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a trial by jury and to participate in class actions.

12. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to acts of God, war, natural disaster, internet outages, or government restrictions.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of New York. All disputes shall be brought in the courts located in New York County, New York.
